1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "Contractor," "you," or "your") and PinPoint Contact ("PinPoint Contact," "we," "us," or "our"), regarding your access to and use of pinpointcontact.com, the Vitra voice agent widget, associated edge APIs, and software services (collectively, the "Service").
By visiting our website, embedding our script tag on your domain, submitting a lead intake form, or completing an activation deposit, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.
2. Description of the Service & Vitra AI
PinPoint Contact provides conversational AI receptionist software designed specifically for trade contractors, field service providers, and home improvement businesses. The Service includes:
- Vitra Voice Widget: An embeddable in-browser voice assistant that engages website visitors via real-time speech and text.
- Progressive Intake & Qualification: Intelligent capture of caller job descriptions, emergency triage, customer contact details, and location.
- Instant Dispatch Alerts: Real-time SMS and email notifications dispatched to contractor personnel upon qualification of urgent job requests.
- Turnkey Onboarding: Done-for-you configuration, custom trade script generation, and script embed assistance.
3. Audio Streaming, Microphone Use & Consent
The Vitra widget utilizes modern web browser APIs (including Web Audio API and WebSockets) to enable bidirectional voice communication.
- Explicit User Activation: Vitra never accesses a visitor's microphone without intentional user action (such as clicking the audio orb or activation button) and native browser permission granting.
- Contractor Notice Responsibility: As a contractor embedding Vitra on your website, you agree to maintain a compliant privacy policy on your domain disclosing the use of automated voice assistance, speech processing, and communication transcription.
- Two-Party Consent Compliance: You acknowledge that Vitra includes clear visual listening/speaking indicators and audio greeting cues disclosing its nature as an AI assistant to ensure compliance with applicable wiretapping and conversational consent laws.
4. Subscription Tiers, 14-Day Trial & $49 Deposit Policy
A. 14-Day Software Trial: Qualified accounts receive a 14-day evaluation period starting from the date of initial setup delivery.
B. $49 Turnkey Setup Deposit: A one-time refundable deposit of $49 is collected at checkout to allocate dedicated developer engineering time for custom trade voice scripting and embed validation. If you cancel your service within the 14-day trial period prior to the first monthly subscription billing date, your $49 deposit will be refunded in full.
C. Recurring Subscription: Following the 14-day trial, your designated payment method will be billed automatically on a recurring monthly basis according to your chosen plan:
- Core Plan: $149/month
- Pro Growth Plan: $249/month
- Enterprise Plan: $399/month
D. Cancellation: You may cancel your subscription at any time by notifying our support team at [email protected]. Cancellations take effect at the conclusion of the active billing cycle.
5. Instant SMS Dispatch Alerts & TCPA Terms
By providing your mobile telephone number during intake or account activation, you affirmatively consent to receive transactional and operational Short Message Service (SMS) alerts regarding:
- Inbound lead qualifications and emergency service calls captured by Vitra.
- Account setup updates, testing verifications, and urgent system alerts.
Consent to receive transactional lead alerts is an operational element of the Vitra dispatch service. Standard message and data rates may apply depending on your cellular provider. You may reply STOP at any time to halt SMS alerts or HELP for assistance.
6. Prohibited Uses & License Restrictions
You agree not to, and will not permit any third party to:
- Reverse engineer, decompile, disassemble, or derive the source code of Vitra or the edge audio engines.
- Resell, sublicense, or distribute the widget script to uncontracted third-party domains without express written authorization.
- Use the Service for fraudulent, abusive, unlawful, or spam-generating activities.
- Attempt to compromise the security, rate limits, or integrity of Cloudflare Edge endpoints or Firestore databases.
7. AI Limitations & Disclaimer of Trade Warranties
Vitra is an artificial intelligence receptionist and triage tool. Vitra is NOT a licensed contractor, engineer, or master tradesperson.
Vitra does not issue binding structural, electrical, or plumbing guarantees. PinPoint Contact is not liable for errors in customer-provided job descriptions, missed leads due to cellular carrier SMS delivery delays, or technical outages on third-party host websites.
Emergency Warning: Vitra is not an emergency response service and cannot dispatch 911, fire, police, or medical personnel.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall PinPoint Contact, its officers, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, revenue, data, or goodwill) arising from your use of or inability to use the Service.
Our total cumulative liability for any claim arising out of or related to these Terms or the Service shall not exceed the total amount paid by you to PinPoint Contact in the three (3) months preceding the event giving rise to liability.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any dispute or controversy arising out of these Terms shall be resolved through confidential, binding individual arbitration.
